Terms of Sale
Last updated: 20 Oct 2026
These terms apply when you buy a BestByLocals guide. They're written in plain English on purpose. If anything here is unclear, email us at [email protected] before you buy.
1. Who we are
BestByLocals is operated by CASPER CREATIVE SOLUTIONS, a sole proprietorship registered in Malaysia (SSM registration no. NS0328529-A) ("we", "us"). Contact: email [email protected] · phone +60 193872203.
2. Who you're buying from
Payments are processed by our third-party payment provider, which may act as the reseller (merchant of record) for your purchase; its name is shown at checkout and on your receipt. The provider takes your payment, issues your receipt, and may calculate, collect and pay any sales tax, VAT or GST due on your purchase. The provider's own terms also apply to the payment itself. We remain responsible for the guide and for these terms.
3. Discounts
Discount codes are applied on our payment provider's checkout page. Only one discount code can be used per order, and each code has its own conditions (for example the dates it is valid). We don't show crossed-out "was" prices: the price shown is the price, and a code reduces it at checkout.
4. Age
You must be 18 or older to buy a guide. At checkout you confirm this by ticking "I am 18 or older."
5. What you're buying
A digital local food guide to one city area. Depending on the tier you choose, it lists stops, one tasting per dish with the vendor's price, background stories, drinks, sights nearby and recommended toilets.
What you are not buying:
- Food or drink. You pay each vendor directly, at their prices. Our price is for the guide only.
- A tour or a guide in person. There is no group and nobody meets you.
- A reservation. Vendors are independent businesses. We don't control their opening hours, prices, menus, queues or food.
- Transport, entry tickets or insurance.
Vendors don't pay to be in our guides, and we take no commission on what you spend with them.
The number of tastings offered per tier and the access days are shown before you buy:
| Tier | Tastings | Price | Access |
|---|---|---|---|
| Express | At least 5 priced tastings · 6–7 on the route | US$15 | 3 days |
| Classic | At least 10 priced tastings · 13–15 on the route | US$25 | 4 days |
| Signature | At least 15 priced tastings · 20–24 on the route | US$35 | 5 days |
| Grand | At least 25 priced tastings · 30–35 on the route | US$50 | 6 days |
| Mega | At least 35 priced tastings · 40–45 on the route | US$65 | 7 days |
| Ultimate | At least 50 priced tastings · 55–60 on the route | US$80 | 8 days |
Your group. One guide is for you and the people you travel with — there's no limit on group size and the price is the same whatever the size of your group. Each person pays the vendors for their own food and drink.
6. How delivery works
- At checkout you choose a start date and time, in the destination's local time.
- We email you a private link to your guide 24 hours before your start.
- If you buy less than 24 hours before your start, we send the guide immediately.
- The guide is delivered only as a private web page. There is no PDF or app, and it isn't a file you can download. You need a phone (or computer) with a current web browser and an internet connection to open it.
Your guide opens in your phone's web browser — no app needed. You'll need mobile data or Wi-Fi to open it and for map directions. Once opened, it also works through short gaps in signal. Access ends automatically when your tier's access days are up. Access days by tier: Express 3 days, Classic 4 days, Signature 5 days, Grand 6 days, Mega 7 days, Ultimate 8 days.
7. How long you can use it
Your link works from delivery until your start + (access days − 1) days − 1 minute, in the destination's local time. For example, with a 3-day tier and a start of Saturday 10:00, the guide arrives Friday 10:00 and access ends Monday 09:59. After that, the page shows "Your access has ended", including any copy saved on your phone for signal gaps.
8. Cancellations, refunds and date changes
- Free cancellation until your guide is sent. Email [email protected] with your order number before the delivery time and we'll refund you in full to your original payment method through our payment provider.
- No refund after your guide has been sent, because you have received the digital content.
- Purchases made less than 24 hours before the start get the guide immediately and are not refundable.
Changing your start date: you can change it once, free of charge, by emailing [email protected] any time before your guide is sent (start − 24 hours). Your delivery time and access window move with the new date. Once the guide has been sent, the date is fixed.
Full details are in our Refund & Cancellation Policy.
9. EU and UK customers: right of withdrawal
If you live in the EU or the UK you normally have 14 days to withdraw from an online purchase. For digital content, that right ends once delivery starts, if you have agreed to this. At checkout you tick:
"I ask for my guide to be sent before the 14-day withdrawal period ends, and I understand that I lose my right of withdrawal once the guide has been sent."
Until your guide is sent, you can still cancel for free (section 8).
10. Accuracy of the guide
We publish only what vendors confirm, and we show the date vendor details were last verified on each destination page. Known closed days and thin days are disclosed before you buy. Even so, prices, hours and menus can change without notice. If something in your guide is wrong, please tell us — it helps the next person.
We may correct or update a guide during your access window (for example a new opening time or a replacement for a closed vendor). Updates made after your access has ended aren't sent to you.
Your statutory rights. If you are a consumer, nothing in these terms limits the rights you can't give up under the law where you live — for example the Malaysian Consumer Protection Act 1999, the UK Consumer Rights Act 2015 or EU consumer law — including a remedy if the guide is faulty or not as described.
11. Your safety and health
You walk at your own pace and your own risk. Watch the traffic, the weather and your belongings. Food is prepared by the vendors, not by us: if you have an allergy or dietary requirement, ask the vendor before you eat. We cannot guarantee ingredients. Please read the food and dietary notice and the rest of our Disclaimers & Liability before you buy — they are part of these terms.
12. Using the guide
The guide is for your personal, non-commercial use and that of the people you travel with: we give you a personal, non-transferable right to use it during your access window. It is not for:
- passing on to anyone outside your group, even for free — if a friend wants to do the walk, they buy their own guide;
- selling, renting or reselling;
- running paid tours or group events;
- publishing or reposting, in whole or in part;
- copying with automated tools, or any other business use.
The guide — its routes, selection of vendors and dishes, stories, maps and text — is protected by copyright and stays ours. Buying a guide doesn't transfer any of these rights to you.
12A. Suspending access
We may suspend or end access to a guide if we reasonably suspect fraud, if the link has been shared outside your group or published, if the payment is reversed or disputed, or if you seriously break these terms. This doesn't affect your statutory rights.
13. Our liability
Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer where you live. This includes our liability for death or personal injury caused by our negligence, and for fraud. Otherwise, our total liability to you for any guide is limited to the price you paid for it, and we're not liable for loss of profit or indirect or consequential loss. We're not liable for vendors' acts, prices, food or opening hours. More detail is in our Disclaimers & Liability.
14. Changes to these terms
We may update these terms. The version in force when you bought applies to your purchase.
15. Law and disputes
These terms are governed by the laws of Malaysia. If you are a consumer living elsewhere, you also keep the mandatory protections of the law of your country of residence, and you may bring a claim in your local courts.
These terms are written in English. If we publish a translation, the English version applies where the law allows.
